House Bill 2005, sponsored by National Alliance of Mental Illness (NAMI Oregon) and championed by Governor Kotek and the First Lady (her mental health advisor) passed in 2025, despite strong opposition from Disability Rights Oregon and numerous people with lived experience of the mental health system. The new law essentially lowers the threshold for involuntary commitment in Oregon, making it easier to institutionalize people who are deemed to be mentally ill. While we can’t undo this bill easily, we can take steps to mitagate the harm that may result by insisting that peers be involved in the involuntary commitment process. Read more below.
The new law essentially lowers the threshold for involuntary commitment in Oregon, making it easier to institutionalize people who are deemed to be mentally ill. Once a person under civil commitment is confined to an institution, they are at risk of being restrained, forcibly drugged and electroshocked. Being civilly committed, also makes it it more likely that a person living peaceably in the community must ‘voluntarily’ submit to mental health treatment, such as monthly injections. If they refuse, they may be locked up. The bill was the result of a the ‘Commitment to Change’ (C2C) workgroup which met for two years. The C2C workgroup did not include any individuals with a diagnosis of serious mental illness who possessed, first-hand experience of the mental health system, i.e. experience being locked up or forcibly treated.
